Terms of Use (EULA)

By accessing or using the Nerve website or downloading, installing, or using the Nerve app, you agree to be bound by these Terms of Service and any applicable laws. If you do not agree, do not use the website or app.

These terms apply to the public-facing website, the mobile app, newsletter or waitlist forms, informational content, and support communications linked to Nerve.

Subject to these terms, Nerve grants you a limited, revocable, non-exclusive, non-transferable, non-sublicensable license to install and use the Nerve app for your personal, non-commercial use on devices you own or control.

The app is licensed, not sold. Except as permitted by applicable law or by any open-source license that applies to a component of the app, you may not copy, modify, distribute, sell, lease, reverse engineer, decompile, attempt to extract source code from, or create derivative works from the app.

Nerve provides educational and product information about confidence-building tools and experiences. The website and app are not medical, psychological, therapeutic, or crisis-response advice.

You should not rely on the website or app as a substitute for professional medical or mental health guidance. If you need urgent help or believe you are in danger, contact emergency services or a qualified professional right away.

You may use the website or app only if you are legally able to enter into a binding agreement under the laws that apply to you.

If you contact us or join a newsletter or waitlist, you agree that we may respond to your message and send product or support-related communications connected to your request.

You agree not to misuse the website or app, attempt to disrupt normal operation, or use Nerve in a way that harms Nerve, other users, or third parties.

If you download the Nerve app from Apple's App Store, you acknowledge that these app-related terms are between you and Nerve only, and not with Apple. Nerve, not Apple, is solely responsible for the app and its content.

Your license to use the iOS app is limited to use on Apple-branded products that you own or control, subject to the App Store usage rules. Where Apple permits it, the app may also be accessed through Family Sharing, volume purchasing, or similar Apple account features.

Nerve, not Apple, is responsible for maintenance, support, and claims relating to the app, including product liability, legal or regulatory compliance, consumer protection, privacy, and intellectual property infringement claims. If the app fails to conform to an applicable warranty, you may notify Apple and Apple may refund the purchase price, if any, paid for the app; to the maximum extent permitted by law, Apple has no other warranty obligation with respect to the app.

You represent that you are not located in a U.S.-embargoed region and are not on any U.S. Government list of prohibited or restricted parties. You must comply with applicable third-party terms when using the app, and you acknowledge that Apple and its subsidiaries are third-party beneficiaries of the app-related terms in this agreement and may enforce them against you. The Nerve name, branding, visuals, copy, app, and site design are owned by Nerve or its licensors and are protected by intellectual property laws.

You may use the website and app for personal, non-commercial purposes. You may not copy, republish, modify, distribute, or commercially exploit Nerve content without prior written permission.

The website or app may link to third-party platforms, app stores, or other external resources. We do not control those services and are not responsible for their content, privacy practices, availability, or terms.

Your use of any third-party service is governed by that provider's own policies and agreements.

The website and app are provided on an "as is" and "as available" basis. To the fullest extent permitted by law, Nerve disclaims all warranties, whether express, implied, or statutory, including warranties of merchantability, fitness for a particular purpose, and non-infringement.

We do not guarantee that the website or app will always be available, secure, error-free, or suitable for your specific goals.

To the fullest extent permitted by law, Nerve and its affiliates, officers, employees, and contractors will not be liable for any indirect, incidental, special, consequential, or punitive damages arising from or related to your use of the website or app.

Our total liability for claims relating to the website or app will not exceed the greater of one hundred U.S. dollars (US $100) or the amount you paid us, if any, for the specific service giving rise to the claim.

We may update the website or app, suspend access, or change these terms from time to time. Updated terms become effective when posted on this page with a revised effective date.

Your continued use of the website or app after a change means you accept the updated terms.
